Right to Consult an Attorney

Any person who has been imprisoned detained is allowed to consult with an attorney of his or her choosing. You have the right to speak with an attorney after being arrested, before police questioning, and before being moved out of the state for any reason. There is one rare exception to this rule that applies when police believe a suspect poses an imminent danger of harm or escape.

Right to Consult a Family Member

People may also communicate with any family member of their choosing via telephone calls within reasonable time limits. If a person is transferred to a different place of custody, he or she must be permitted additional time to speak with his or her family member. These same rights are renewed when he or she must speak with an attorney.
