Q: What is the difference between DUI and DWI?

There is no legal difference between driving under the influence (DUI) and driving while intoxicated (DWI). These two terms refer to the same crime – operating a motor vehicle with a blood alcohol content level above the legal limit.

Depending on the state, the legal system may use either DUI or DWI to describe this crime. In Illinois, DWI is not found anywhere in the state statute, but it is quite often used interchangeably with DUI.
